Overview
Uncovering different pathways to reach your desired outcome
Most disputes are resolved through negotiations, including lawsuits. Early resolution can reduce cost and disruption to the parties, especially when compared to lengthy lawsuits, trials and appeals. Foster Garvey’s dispute resolution attorneys are skilled negotiators and employ a variety of alternative dispute resolution (ADR) procedures when appropriate to accomplish creative resolutions of disputes outside the courtroom. Those procedures include mediation and arbitration.
Mediation
Whether by agreement or required by court or forum rules, virtually every lawsuit or arbitration will go through the mediation process. Our dispute resolution lawyers are skilled in identifying skilled neutral mediators with the right skills and temperament for particular cases. We have achieved exceptional results for clients in mediation across a broad range of legal areas. These include class actions, business disputes, labor and employment disputes, tax matters and municipal matters, including condemnation cases.
Arbitration
Arbitration is an increasingly common form of dispute resolution for business disputes, commercial matters and consumer disputes. With arbitration, the parties to a dispute select one or multiple arbitrators to consider and decide the issues in a binding award. Our attorneys assist clients in adopting arbitration provisions in their key contracts and policies, including client-specific procedures for efficiently resolving employment disputes. We won a groundbreaking case establishing new precedent on the disclosures that arbitration service providers must make about possible conflicts of interest.
We represent our clients as advocates in arbitrations across a wide variety of subject matters including consumer claims (individual and class actions), commercial disputes, employment and labor matters, intellectual property issues and real estate disputes.
