By accessing or using our websites and other online information, products or services (collectively, the “Online Information”), you agree to be bound by these Terms of Use (“Terms”) and all other terms incorporated by reference. If you do not agree to these Terms, do not access or use the Online Information. These Terms apply to your access to and use of the Online Information provided by Foster Garvey PC (“Foster Garvey,” “we,” “us,” or “our”).

We reserve the right to change or modify these Terms at any time and in our sole discretion. If we make material changes, we will update the “Last Updated” date and may provide additional notice (e.g., via homepage statement or email). Your continued use of the Online Information following any changes confirms your acceptance of the updated Terms. If you do not agree to the amended Terms, you must stop using the Online Information. 1. Privacy
Please refer to our Privacy Policy for information on how we collect, use, share, and otherwise process information from users in connection with the Online Information.

2. No Legal Advice; Attorney Advertising
The Online Information is provided for general informational purposes only and does not constitute legal advice or a substitute for advice from a qualified attorney.  Online Information may not reflect recent legal developments, may not be complete, and may not apply to your specific situation or jurisdiction. You should not act or refrain from acting based on any Online Information without first consulting an attorney qualified in the relevant subject matter and jurisdiction.

3. No Attorney-Client Relationship
Foster Garvey enters into attorney-client relationships only through specific procedures, including a conflicts check, an executed engagement letter, and other procedures.  Accessing the Online Information or merely communicating  (e.g., via email or voicemail) with people at Foster Garvey does not create an attorney-client relationship.

Communications via the Online Information or via other means (such as email or voicemail) may not be secure and may not be protected by the attorney-client privilege or other client confidentiality protections.  Unsolicited communications to Foster Garvey will not be considered confidential, do not create an attorney-client relationship, and Foster Garvey assumes no responsibility for their confidentiality or return. If you are not an existing client of Foster Garvey, do not provide confidential information to Foster Garvey without prior authorization.

4. Authorized Jurisdictions
The Online Information may be accessed worldwide, but Foster Garvey attorneys are licensed only in the jurisdictions listed in their individual biographies in the Online Information. Unless specifically stated, no attorney is certified as a specialist by any professional or governmental authority. Practice group listings or other indicia of expertise do not imply certification.

5. Eligibility
You must be at least 18 years of age (or the age of legal majority in your jurisdiction) to use the Online Information. If under that age, you may use the Online Information only under the supervision of a parent or legal guardian who agrees to these Terms. If using the Online Information on behalf of an organization (including any business entity or legal entity), you represent that you are authorized to bind that organization.

6. Intellectual Property Ownership and Limited License
The Online Information and its content (including text, graphics, images, data, and software) are owned by Foster Garvey or by our licensors and are protected by U.S. and international laws. Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to access and view the Online Information for personal, non-commercial purposes. Any other use requires our prior written permission. Trademarks contained within the Online Information (other than Foster Garvey’s) are owned by their respective owners and do not imply endorsement.

7. Repeat Infringer Policy; Copyright Complaints
We respect intellectual property rights and have a policy of terminating access for repeat infringers under the Digital Millennium Copyright Act (DMCA) and applicable law. 8. Third-Party Content
The Online Information may include links to or content from third parties. Foster Garvey does not control, endorse, or assume responsibility for third-party content, sites, or services. Your interactions with them are at your own risk.

9. Prohibited Conduct
You agree not to use the Online Information to:

  • Violate any law or facilitate illegal activity
  • Infringe intellectual property rights
  • Transmit unsolicited communications or defamatory/fraudulent material
  • Violate security or integrity of the Online Information


We may limit or terminate access for violations.

10. Indemnification
To the fullest extent permitted by law, you will indemnify and hold harmless Foster Garvey and its affiliates, officers, directors, employees, and agents from any claims, losses, or expenses (including attorneys’ fees) arising from your use of the Online Information, violation of these Terms, or infringement of third-party rights.

11. Disclaimer of Warranties
The Online Information is provided “as is” and “as available” without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Online Information will be uninterrupted, error-free, or secure.

12. Limitation of Liability
To the fullest extent permitted by law, Foster Garvey will not be liable for indirect, incidental, consequential, or punitive damages arising from your use of the Online Information.  Our total liability will not exceed $50 or amounts paid by you (if any) for the Online Information.

13. Governing Law and Venue
These Terms are governed by the laws of the State of Washington (without regard to conflict of laws principles). Any disputes will be resolved exclusively in state or federal courts in King County, Washington.

14.  Miscellaneous
If any provision is unenforceable, the remainder remains in effect. These Terms constitute the entire agreement regarding the Online Information.
