Foreign nationals resident in the United States or owning U.S. property are faced with unique tax issues when undertaking estate planning. Advisers must be cognizant of the special legal and tax rules when developing plans or advising clients on cross-border estate matters. This forum will provide advisers with useful and timely information about U.S. estate taxation of foreign nationals, effective use of estate tax treaties, and how to avoid pitfalls related to differences in spousal property rights in the jurisdiction of residency compared to the situs of the property. These areas will also be explored in the context of the uncertainty that exists with current U.S. tax law and the need to provide flexibility in estate planning to accommodate future changes in the tax law.
