The use of eminent domain to preserve habitat or open space presents a modern stress test for the constitutional “public use” requirement. Unlike condemnations for roads, utilities or public buildings, takings for habitat or open space involve intentionally removing land and productive use, often restricting or eliminating public use. This presentation will examine:

    • The judicial evolution process of “public use,” and
    • How recent cases illuminate both the expanding possibilities and unresolved limits of conservation-based takings, with a primary focus on recent Washington state experience
