Foster Pepper has been a leader in developing and defending creative procurement programs for Washington municipal governments. We drafted the public-private partnership law for wastewater facilities (Water Quality Joint Development Act, chapter 70.150 RCW) and rewrote the State's solid waste services procurement law (RCW 35.21.156; chapter 36.58 RCW).
As a result of our many years of experience working for governmental entities to prepare the various agreements governing public construction projects, we have significant expertise in public construction contracting. We are very experienced in public bidding requirements (and the important exceptions to those requirements), payment and performance bonds, prevailing wage rules, and all the other rules and regulations unique to public construction contracting.
