In addition to our broad-ranging litigation experience, Foster Pepper is litigating and resolving sustainability questions.

• Settled appeals on Klickitat County’s energy overlay zone. The zoning authorizes wind and solar projects outright, and was expected to be in litigation for years. We settled the case before it was briefed.
• Successfully defended Initiative I-937. The initiative requires clean energy investment.
• Won summary judgment in King County Superior Court upholding Seattle City Light’s authority to mitigate its green house gas emissions with offset contracts, including for mitigation outside Seattle. Washington’s Supreme Court reversed in a 5-4 decision. The Legislature immediately responded with legislation overturning the Court and authorizing municipal utilities to purchase greenhouse gas mitigation.
